Terms and Conditions

Deposits and Fees

A deposit must be paid in full at the time of booking. Deposit secures the time and services of the Photographer for the sitting and is non-refundable. Sessions that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time.

Following payment of the deposit, balance of any fees due is to be paid before the session. No images will be delivered until all payments due have been paid in full. Payment for additional images, products, and albums is to be made when they are ordered.

Galleries and Images

A proof gallery will be available to the Client within 72 hours of the date of the session, and will be available for at least 7 days for the Client to choose their favorite images. Favorite images are edited within 2 - 4 weeks of the date chosen. The gallery of edited images is available to the Client for at least 30 days for downloading and purchasing of prints. After 30 days all images will be deleted. The Photographer is not responsible for resupplying any images not downloaded within that time. All downloadable digital images purchased at the booking of the session, and thereafter, are edited, mid-resolution images optimized for viewing online. See Copyright and Client Usage below. Full resolution downloadable digital images with reproduction rights are available for purchase.

Under no circumstance will unedited images be made available to the Client to download.

Copyright and Client Usage

All photographic materials, including but not limited to digital files, negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer. The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions, unless a license to use the images has been purchased or granted.

The Client is obtaining images for personal use only, and shall not sell said images or authorize any reproductions thereof by parties other than the Photographer. Without permission from the Photographer, the Client shall not download, copy, print, screen shot, use as a basis for derivative works, manipulate in any way, or otherwise use the Photographer’s images.

If Client is obtaining an image for reproduction or publication, Photographer authorizes Client to reproduce the image only as agreed upon by Client and Photographer. In such event, Client shall request that a credit for the Photographer be placed adjacent to the photograph on publication, but shall have no liability if the publication refuses or omits to do so.

The Photographer reserves the right to display any images as samples of their work.

Social Media

Please give Paige S. Wilson credit when posting images online. No alterations to the images are permitted.

Cancellations and Rescheduling

The Client may cancel their session at any time by giving written notice to the Photographer but in doing so shall forfeit any monies paid. Cancellation less than 72 hours before the agreed session date will result in payments made being forfeited.

Session bookings that are postponed to a later date will retain the booking fee as long as the photographer can re-schedule for the new date and time and that the rescheduled date and time fall within 30 days from original session date.

Late Policy

The Photographer allows a 15 minute grace period for all sessions. If the Client  arrives to their session later that 15 minutes, the time will be deducted from their session duration.

Personal Accident

Any directions issued to clients, their guests or employees during a photographic shoot/event are deemed to be at said person's own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

Failure to Perform

If the Photographer cannot perform this Agreement due to an emergency or a cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

Any complaints should first be raised by the Client with the Photographers in writing within 14 days from the date of receipt of images.
